2. WHAT DATA DO WE COLLECT ABOUT YOU, FOR WHAT PURPOSE AND ON WHAT GROUND WE PROCESS IT

Personal data means any information capable of identifying an individual. It does not include anonymised data.

We process the following categories of personal data about you:

Reservation Data that includes your name, email address, phone number, applicant type (student, expatriate, or parent helping a son or daughter), rental duration, check-in and check-out dates, and any message you send us through the reservation form. We process this data to assess your rental request, communicate with you about your stay, and take the steps you request in view of preparing a rental contract. Our lawful ground for this processing is the performance of steps taken at your request prior to entering into a contract (Article 6(1)(b) GDPR).

Tenancy Documentation Data that, if your application progresses, is collected mostly outside the website by email or through our guarantee and insurance partners - such as proof of identity, proof of student status or income, guarantee documents (via a rental-guarantee provider such as Garantme, Studapart, or Housing Anywhere), home insurance details, and security deposit information. Our lawful ground for this processing is the performance of the rental contract, or the steps necessary to enter into it, and compliance with the legal obligations that apply to a residential landlord in France.

Communication Data that includes any other message you send us, whether by email, WhatsApp, or through a booking call. We process this data to reply to you, keep records, and establish, pursue or defend legal claims where necessary. Our lawful ground for this processing is our legitimate interest in responding to enquiries and keeping accurate records.

Technical Data limited to what is described in our Cookie Policy. We do not use Google Analytics, Meta Pixel, or any advertising or tracking cookies. Our lawful ground for this minimal, cookieless analytics is our legitimate interest in understanding basic website usage and keeping the site secure.

We do not use your data for advertising or marketing purposes, and we do not currently send marketing communications. If this were to change, we would ask for your consent first.

Sensitive Data

We do not collect any Sensitive Data about you. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and

genetic and biometric data. We do not collect any information about criminal convictions and offences.

Where we are required to collect personal data by law, or under the terms of a contract between us, and you do not provide us with that data when requested, we may not be able to process your rental application or enter into a rental contract with you. If this happens, we will notify you at the time.

We will only use your personal data for a purpose it was collected for or a reasonably compatible purpose if necessary.

For more information on this please email us at data.protection.officer@parisdeoheya.com. In case we need to use your details for an unrelated new purpose we will let you know and explain the legal grounds for processing.

We may process your personal data without your knowledge or consent where this is required or permitted by law.

We do not carry out automated decision making or any type of automated profiling.

3. HOW WE COLLECT YOUR PERSONAL DATA

We collect data about you when you provide it directly to us - for example by filling in the reservation form on our site, or by sending us emails or messages. Please see our Cookie Policy for details of the minimal, cookieless analytics we use.

We may receive data from our guarantee and insurance partners (Garantme or Studapart) and from an eSignature provider (such as Dropbox Sign) as part of processing a rental application you have started with us.

4. WHO WE SHARE YOUR DATA WITH

We may have to share your personal data with the parties set out below:

  • Formspree, the third-party service that processes our reservation form submissions. Formspree is based in the United States; any transfer of your data outside the EU is subject to the safeguards required under GDPR;
  • A rental-guarantee provider (such as Garantme, Studapart, or Housing Anywhere), if your application requires a rental guarantee or home insurance;
  • Our eSignature provider (such as Dropbox Sign), to prepare and sign your rental contract;
  • A real estate agency, if one is involved in verifying your documents or handling the signature of your lease;
  • Cloudflare, our hosting and cookieless analytics provider.

We will never sell your personal data.

5. DATA SECURITY

We have put in place security measures to prevent your personal data from being accidentally lost, used, altered, disclosed, or accessed without authorisation. We also allow access to your personal data only to those partners who have a business need to know such data. They will only process your personal data on our instructions and they must keep it confidential.

We have procedures in place to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach if we are legally required to.

6. DATA RETENTION

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. If your rental application does not proceed, we retain your reservation data only for as long as necessary to handle any related enquiries, then delete it. If you become a tenant, your data is retained for the duration of your tenancy and for the periods required by French legal, tax, and accounting rules afterwards.

In some circumstances, we may anonymise your personal data for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

7. YOUR LEGAL RIGHTS

Under GDPR and the French Data Protection Act (Loi Informatique et Libertés), you have rights in relation to your personal data that include the right to request access, correction, erasure, restriction, transfer, to object to processing, to portability of data and (where the lawful ground of processing is consent) to withdraw consent.

If you wish to exercise any of the rights set out above, please email us at data.protection.officer@parisdeoheya.com.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive, or refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex. In this case, we will notify you.

If you are not happy with any aspect of how we collect and use your data, we should be grateful if you would contact us first so that we can try to resolve it for you: data.protection.officer@parisdeoheya.com. You also have the right to lodge a complaint at any time with the CNIL (Commission Nationale de l'Informatique et des Libertés), the French data protection authority: https://www.cnil.fr/en/rights-inform-yourself
